February 2020 SPRAY 35
The inaugural HCPA Innovation Awards were open to formulators,
manufacturers and distributors of household and commercial products.
A panel of expert judges ranked the nominated products and Innovation
Award winners were recognized during the Annual Meeting.

not based on the evidence contained in the record.” In addition,
Commerce’s responsiveness to certain requestors created
“the perception of undue influence.”
To maximize the chances of getting an exclusion, Dunham
recommended filling out the application correctly. Leaving
blanks or improperly handling confidential business information
can lead to a rejection before the merits are considered.
Make the strongest case possible. Address all of the criteria
and present a thorough, well-documented case. Most of these
exclusions are worth millions of dollars, so put in the time and
resources to paint a clear, compelling picture.
Dunham also recommended developing and executing an
advocacy plan. The White House, U.S. Trade Representative
(USTR) and the Dept. of Commerce often hear from members
of Congress and other political allies about exclusion requests,
and there is evidence that those requests are considered more
quickly and favorably. At minimum,
companies should meet with their
congressional delegation and ask for
help. Recruiting suppliers, customers
and others who might benefit from the
exclusions is also helpful.
