The Coronavirus Aid, Relief & Economic Security Act
(CARES), passed in March 2020, includes five sections
on over-the-counter (OTC) drug review. Section
3954 will bring the Sunscreen Innovation Act (SIA) to
an end on Sept. 30, 2022. President Barack Obama
signed the SIA into law in 2014; it allowed for an accelerated
review and approval process for sunscreen
actives.
According to a report on the CARES Act from international
law firm Covington, “Section 3954 would
also make changes to harmonize the procedures under
the SIA with those under the OTC Drug Review. The
final sunscreen order will no longer be incorporated
into the final sunscreen monograph. Instead, a final
sunscreen order will automatically be deemed to be a
final administrative order.”
U.S. consumers who do use sunless tanner, 68% say
safety is their reason for usage. Mintel suggests that
sunless tanner brands can learn from sun care brands
and bring safety into the conversation.
