Maryland is using the 2014 Model Rule from the Ozone Transport Commission (OTC), which is based on existing CARB Consumer Product Rules. Most, if not all, of the proposed regulation is consistent with the 2014 OTC Model Rule. The categories being updated appear in the chart at right and on page 8. One major issue with this proposed regulation is the effective date. Maryland wants to have this regulation to be effective on 1/1/2017. This would be consistent with New Hampshire and Delaware. The proposed timeline: • June 6: meeting with the agency’s advisory counsel • October: Public hearing • December: Final publication • Jan. 1, 2017: Effective date This is a very aggressive time frame. At the stakeholder meeting, industry pushed back on the effective date. The agency gave two weeks to supply comments to the proposal. Ozone Transport Commission The Ozone Transport Commission (OTC) held a regularly scheduled meeting on April 12 in Washington DC. We are expecting them to unveil the plan to have a voluntary measure to claim State Implementation Plan credits from Consumer Products and Architectural Coatings. More to come on this.
